You are hereby informed that said social networks are platforms owned by third parties and, accordingly, the circulation and use of User Content via said social networks shall be governed by the terms of use defined by said third parties. We can therefore not be held responsible for any use of the content by us or any third parties in accordance with the terms of use defined by the social networks, including without limitation, in terms of the scope and duration of licensed rights, and removal of the User Content. You shall be responsible for handling any third-party claims relating to the use of the User Content in accordance with the terms of use defined by the social networks.

  7. (v) any misrepresentation or breach of representation or warranty made by you contained herein.
    References in this section of the Terms to your use of our Site shall be deemed to include any use by a third party where such a third party accesses our Site using your computer.
    You agree to pay L’Oréal, its employees, representatives, and agents any and all costs, damages, and expenses (including reasonable legal fees) awarded against any of them or otherwise incurred by any of them in connection with or arising from any such third party claim, suit, action or proceeding attributable to any such third party claim.

LOCAL LAWS AND REGULATIONS

In relation to the use of the Modiface Virtual Try On functionality available within the Website, you grant to L'Oréal a royalty free, non-exclusive, transferrable, sub-licensable, irrevocable licence to use any image that you upload to the Website for the purpose of providing you with the [Virtual Try On]  functionality.

L'Oréal grant you a limited non-exclusive, non-transferrable, revocable licence to use the Modiface Virtual Try On functionality available on the website in the United Kingdom and the Republic of Ireland, solely for the purposes anticipated in the following section (Modiface Virtual Try On functionality available within the website). This licence is granted to you free of charge. 

By uploading an image to the Modiface Virtual Try On feature of the Website, you affirm, represent and warrant that you are the owner of, or have the necessary licences, rights, consents and permissions to use and to authorise L'Oréal to use such image as necessary to exercise the licence granted by you in these Terms.

The Website provides an illustration of the effect of applying a particular product e.g. foundation, and does not constitute a guarantee that the result will be exactly the same tone, colour and/or result when you apply the product. We will not be held liable for any inaccuracies with the results of the Website. To find your shade match, please visit your nearest foundation counter. You can choose to use the live service (using your device webcam) or to use an existing picture (which will be uploaded from your device) and then, based on the product you would like to try on, you will be provided with your image results.  You have the possibility to share the image and the product recommendations via email and you will also have the opportunity to subscribe to the newsletter.   

You will have no obligation to purchase such products that are recommended or otherwise referenced through this feature and L'Oréal does not guarantee the availability of any such products. 

L'Oréal does not guarantee that this feature will be available outside of the United Kingdom and the Republic of Ireland.

1. These Terms and Conditions (“Terms”) set out the terms and conditions which govern the MY LANCÔME REWARDS loyalty programme ("Programme").
2. References to ‘you’ or ‘your’ mean you as a participant in the Programme. References to ‘we’, ‘us’, ‘our’, the ‘organiser’ or ‘Lancôme’ are to the provider of the Programme, which is L’Oréal (UK) Limited, acting through its Lancôme’ trading division. We are registered in: England and Wales under company number 271555 and we have our registered office at 255 Hammersmith Road, London W6 8AZ; Ireland under company number 901549 and we have our registered office at Styne House, Upper Hatch Street, Dublin 2, Ireland.
3. The Terms supplement our website terms of use and our privacy policy.


PURPOSE OF THE PROGRAMME
4. The purpose of the Programme is to allow you to create a member account associated with the Programme to redeem complimentary products with every second purchase of £50/€50 or more (up to a maximum of three complimentary products within a 12 month period) and other exclusive offers (“Rewards”) according to these Terms.

ELIGIBILITY
5. The Programme is voluntary and free of charge. It is open to UK and Irish residents who are 16 years of age or older at the time of registration. You do not need to join the Programme to purchase Lancôme products.
6. The Programme and its benefits are offered at the discretion of Lancôme. Lancôme may, at any time, terminate, change, limit, modify or cancel the Programme (or any individual component of it) and/or these Terms, without notice. By enrolling in the Programme, you hereby agree to abide by these Terms, which may be updated from time to time by Lancôme in its sole discretion and confirm that you meet the eligibility requirements set out herein. Lancôme may take any action it deems appropriate in its sole discretion, including closing or suspending your loyalty account and/or revoking any accrued rewards or vouchers if it has reason to believe you have contravened these Terms or are abusing the Programme in any way.
7. Commercial use (e.g. purchasing product for the purpose of re-selling) of the Programme is strictly prohibited and will be considered an abuse of the Programme. Lancôme reserves the right in its sole discretion, at the point of purchase or retrospectively, to determine whether, in its reasonable opinion, a purchase is for commercial use.
8. Only one Programme account may be associated with a single email address. In the event of a dispute over a Programme membership account, the registration will be deemed to have been made by the authorised account holder of the email address submitted at the time of enrolment. For the purposes of these Terms, the "authorised account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organisation (e.g. business, educational institution) that is responsible for assigning email addresses for the domain associated with the submitted email address.
9. By enrolling in the Programme, members agree to provide true, accurate, current and complete information about themselves and to maintain and promptly update the information to keep it true, accurate, current and complete. If a member provides any data which is untrue, inaccurate, not current or incomplete, or if Lancôme, in its sole discretion, suspects that a member’s registration data is untrue, inaccurate or incomplete or that they are in any way abusing their membership in the Programme, Lancôme reserves the right to suspend, terminate or refuse that member’s participation in the Programme.

HOW TO ENROL OR DISENROL FROM THE PROGRAMME
10. You may enrol in the Programme through www.lancome.co.uk or www.lancome.ie (“the Website”) in the My Account section and will be required to provide your full name, email address, and create a password. You will also be invited to provide your date of birth should you wish to receive exclusive birthday offers. Your enrolment will be confirmed with a welcome message, followed by an email including details of your welcome discount code, sent to the email address provided.
11. You are free to terminate your membership in the Programme at any time, by logging on to your account, accessing your account details in the ‘Account Settings” section and clicking the option to leave the Programme at the bottom of the page. Alternatively, you may disenroll from the Programme by clicking on the unsubscribe button at the footer of each service email that you receive from the Programme.
12. Please allow up to 30 days for any disenrollment to take effect. You will receive an operational email confirming your disenrollment from the Programme. Upon disenrollment, your Rewards will be forfeited.

HOW TO RECEIVE AND REDEEM PROGRAMME REWARDS
13. Once you are enrolled in the Programme, you will earn Rewards on the on the following basis:

15. Rewards have no monetary value and cannot be transferred, bought, sold or traded, except as stated in these Terms.

COMMUNICATIONS AND REVIEWING YOUR ACCOUNT INFORMATION
16. Where you have opted in to receive further marketing communications by email, you may periodically receive emails from Lancôme, including emails about the Programme and other personalised promotions and ads that may be of interest to you. You may opt out of the marketing emails at any time by clicking the unsubscribe button at the bottom of our email or contacting Customer Service by filling out the form on our Website. Where you do not opt in to receive further communications, minimum operational emails will still be sent to members in relation to your membership in the Programme only. Should a member wish to stop receiving all email correspondence, including operational emails, they must cancel their Programme membership and allow 30 days for this to take effect.
17. Members are at all times responsible for ensuring that their email address for the Programme is kept up-to-date and Lancôme are not responsible for any lost or delayed communications regarding the Programme.

COMPLIANCE WITH AND CHANGES TO THE TERMS OF THE PROGRAMME
18. In the event of non-compliance with the Terms, we reserve the right to (i) correct the number or type of Rewards accumulated to reflect the number actually acquired in accordance with these Terms (ii) to terminate to the Programme account of the relevant participant, and to lose all benefits that were associated with that account. In the case of a dispute regarding the Rewards available to any member, Lancôme’s decision will be final.

ABUSE OR MISUSE OF THE PROGRAM
19. By enrolling in the Programme, a member agrees not to (a) take any action or (b) upload, post, submit or otherwise distribute or facilitate distribution of any user content (including text, communications, software, photographs, videos, sound recordings, data or other information) using any communications service, discussion forum, or other feature available on or through the Programme, in any manner, that is unlawful, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, invasive of another's privacy, tortious, obscene, profane, infringes on any patent, trademark, trade secret, copyright, right of publicity, right of privacy, any other right of any party or which otherwise violates Lancôme’s website terms and conditions. Members further agree not to (a) upload any content that imposes an unreasonable or disproportionately large load on Lancôme’s computing, storage or communications infrastructure, or attempts to gain unauthorized access to the Programme, other accounts, computer systems or networks connected to or related to the Programme, through password mining or otherwise; (b) contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware or network system or to damage or obtain unauthorized access to any system, data or other information of Lancôme, or any third party; (c) creates member accounts by any automated means or under false pretences or impersonates any person or entity, including an employee or representative of Lancôme; or (d) harvests, scrapes or collects any information from www.lancome.co.uk.
20. Lancôme assumes no responsibility for any problems or delays related to any of the equipment or programming associated with or utilized by the member; any human error; or any interruption, deletion, omission, defect or failure of any network or electronic transmission for whatever reason.

GOVERNING LAW AND JURISDICTION
22. 23. The Programme and these Terms will be governed by and construed in accordance with the laws of England and Wales.

5. Membership Roses

5.1 Users of our site will join the tokens-based reward programme which will unlock benefits as set out in the Community membership level table below.

5.2 Users will be asked to complete specified tasks, challenges and missions ("Missions"), to collect award Community tokens (known as "Roses") in order to gain certain benefits ("Perks").

5.3 Missions available to you will be listed in the "My Missions" section of your user account. This section will list out the Missions already completed, provide details on the actions required for Missions you have not yet completed and set out how many Roses you can earn for completing each Mission. Roses will be awarded to your user account following completion of each Mission and the subsequent validation by a Community moderator. Collected Roses will be stored in your account indefinitely unless (a) you terminate your user account with us, or (b) we terminate your user account with us due to you breaching these Community Terms.

5.4 We may change, add or amend the Missions and/or how many Roses can be earned for any Mission not yet completed, at our sole discretion by amending the information in the "My Missions" section.

5.5 The table below sets out the Perks that you receive as a result of acquiring a certain number of Roses. We may update this table from time to time, including to introduce new Community levels for users who collect higher numbers of Roses.
