In the Licence Provision:

In relation to the use of the Modiface Virtual Try On functionality available within the Website, you grant to L'Oréal a royalty free, non-exclusive, transferrable, sub-licensable, irrevocable licence to use any image that you upload to the Website for the purpose of providing you with the [Virtual Try On]  functionality.

L'Oréal grant you a limited non-exclusive, non-transferrable, revocable licence to use the Modiface Virtual Try On functionality available on the website in the United Kingdom and the Republic of Ireland, solely for the purposes anticipated in the following section (Modiface Virtual Try On functionality available within the website). This licence is granted to you free of charge. 

By uploading an image to the Modiface Virtual Try On feature of the Website, you affirm, represent and warrant that you are the owner of, or have the necessary licences, rights, consents and permissions to use and to authorise L'Oréal to use such image as necessary to exercise the licence granted by you in these Terms.

 

Modiface Virtual Try On Functionality Available within the Website:

The Website allows you to use the Virtual Try On functionality. This is an online service capable of beauty try-on simulations on live video and photos. The Website provides an illustration of the effect of applying a particular product e.g. foundation, and does not constitute a guarantee that the result will be exactly the same tone, colour and/or result when you apply the product. We will not be held liable for any inaccuracies with the results of the Website. To find your shade match, please visit your nearest foundation counter. You can choose to use the live service (using your device webcam) or to use an existing picture (which will be uploaded from your device) and then, based on the product you would like to try on, you will be provided with your image results.  You have the possibility to share the image and the product recommendations via email and you will also have the opportunity to subscribe to the newsletter.   

You will have no obligation to purchase such products that are recommended or otherwise referenced through this feature and L'Oréal does not guarantee the availability of any such products. 

L'Oréal does not guarantee that this feature will be available outside of the United Kingdom and the Republic of Ireland.

MY LANCÔME REWARDS TERMS AND CONDITIONS

Welcome to the "My Lancôme Rewards" Loyalty Programme (hereinafter the "Programme"), provided by L'Oréal (U.K.) Limited, acting through its Lancôme trading division, incorporated under the laws of United Kingdom, having its registered office at Gateway Central, White City Place, 187 Wood Lane, London, W12 7SA, (hereinafter “Lancôme”, “We”, “Our”. or “Us”).

1. PURPOSE
The Programme allows the persons (hereinafter the "Member(s)", “you” or “your”) who meet the eligibility criteria described hereunder and, who validly register for the Programme on www.lancome.co.uk (hereinafter the “Site”), to benefit from the advantages offered by Lancôme under this Programme.

This document aims to define the terms and conditions of the Programme (hereinafter the “Terms and Conditions”). These Terms and Conditions supplement our Website Terms of Use and Privacy Policy.

2. ACCEPTANCE AND CHANGE TO THE TERMS AND CONDITIONS
By joining the Programme, you hereby agree to be bound by these Terms and Conditions, which may be updated from time to time by Lancôme in its sole discretion and you confirm that you meet the eligibility criteria defined below.

Changes to these Terms and Conditions will be communicated on the Site and via e-mail, and your continued participation in the Programme will constitute your acceptance to those changes.

3. MEMBERSHIP – ELIGIBILITY TO THE PROGRAMME
Please be informed that participation to the Programme is voluntary and that enrolment is not mandatory to purchase Lancôme products.
The Programme is open to any person over the age of 18 who resides in the United Kingdom and ROI.
Only one membership per person will be accepted. Membership is specific to the individual and related to one email address.

Only Members belonging to the Programme may enjoy the benefits described below. We reserve the right to request a proof of your age and identity. Commercial use (e.g., re-selling products received as part of the Programme) of the Programme or use by any other person other than a Member is strictly prohibited and will be considered an abuse of the Programme, in accordance with paragraph 9.

4. HOW TO JOIN THE PROGRAMME

If you provide any information or data which is untrue, inaccurate, or incomplete, or that you are in any way abusing your membership in the Programme, Lancôme reserves the right to suspend, terminate or refuse your participation in the Programme.

You can leave the Programme at any time by unsubscribing from your Lancôme online account or by sending a request to Lancôme via the Consumer Care Form. Lancôme will manage your request with due care and within a reasonable timeframe, however, please allow up to 30 days for disenrollment to be actioned.

Disenrolling will result in the loss of your current points, Tier status, and advantages. If you wish to re-enroll within 18 months with the same personal information, your account and previous Points & Tiers status will be reactivated.

5. DESCRIPTION OF THE PROGRAMME
Our Programme aims to reward and thank its Members for purchasing Lancôme products and/or for their Engagement Actions towards Lancôme.

For each purchase of Lancôme products, and participation in the Engagement Actions you will accumulate points (listed below). The points accumulated during your membership give you access to a specific Tier. Each Tier carries various benefits as set out below.

When you have accumulated enough points, you can redeem the points in the Rewards Boutique when you purchase any Lancôme product on Lancome. co.uk.

You will have access to different rewards depending on your points balance. You can select your reward in return for your earned points. When you have selected and redeemed your reward, points will be deducted from your account. Redeeming points from the Rewards Boutique does not affect the Tier you have reached.

The Rewards Boutique is only available on Lancome.co.uk.

Your points will remain in your loyalty account if you are active within a 12- month period. Being active means earning new points or redeeming them in the Rewards Boutique. If you become an inactive member for 12 months (no new points earned or redeemed), your level status and points will be reset to 0 and you’ll be downgraded to the Rose Tier (Tier 1). You will be notified via email before your membership is removed.

1. How do you accumulate points?
You accumulate points by making the following actions:

To earn points for your purchase on Lancôme.co.uk, please ensure you are signed into your Lancôme Members account before placing an order. You will receive points for every pound you spend.

To ensure you are awarded points for your purchase, you must be connected and logged into your Lancôme Members account and have accepted cookies/trackers when entering the Site. Failure to do so will result in no points being awarded to you as we cannot link your purchase to you or your account.

ii. Taking one of the following Engagement Actions related to the Programme:

Failure to do so will result in no points being awarded to you as we cannot link your Engagement Actions to you or your account.

To keep up to date with all news from Lancome, you can opt in to marketing messages either when you enroll on the Programme or via your account at any time. If you opt in to the newsletters, you will receive emails from Lancome, including personalised promotions and ads. You may opt out of communications at any time by clicking the unsubscribe button at the bottom of our emails or contacting Lancome via our Consumer Care Form.

8. AMENDMENT OR TERMINATION OF THE PROGRAMME
Lancôme reserves the right to modify, change, limit, cancel or terminate the Programme at any time, without advance notice to you. If the Programme is completely terminated and discontinued, Members will be notified and neither the Member nor any third party may seek any recourse or compensation whatsoever.

9. ABUSE OR MISUSE OF THE PROGRAMME
Lancôme reserves the right to take any action it deems appropriate, in its sole discretion, to exclude a Member from the Programme, by closing or suspending the Member’s account, if it has reason to believe that the Member concerned is in breach of these Terms and Conditions or is abusing the Programme in any way.

Exclusion will result in the Member’s account being removed or closed, with immediate loss of all benefits acquired through the Programme, and neither the Member, nor any third party may claim compensation or indemnification whatsoever in regards to points or otherwise.

10. LIABILTIY
Lancôme assumes no responsibility for any direct or indirect problems or delays related to any of the equipment or programming associated with or utilised by the Member; any human error; any interruption, deletion, omission, defect or failure of any network or electronic transmission for whatever reason.

11. APPLICABLE LAW AND JURISDICTION
Lancôme and each Member irrevocably submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute or claim arising from the Programme, the rewards or other member benefits from or relating to the Programme and these Terms and Conditions or a member’s participation in the Programme.

The Programme and these Terms and Conditions will be governed by and construed in accordance with the laws of England and Wales.

4.2 For your own personal protection you must keep your user login details and password safe and treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user login and password or delete your user account at any time if in our reasonable opinion you have failed to comply with any of the provisions of these Community Terms.

4.3 If you know or suspect that anyone other than you knows your login details or password, you must promptly notify us at [email protected].

5. Membership Roses

5.1 Users of our site will join the tokens-based reward programme which will unlock benefits as set out in the Community membership level table below.

5.2 Users will be asked to complete specified tasks, challenges and missions ("Missions"), to collect award Community tokens (known as "Roses") in order to gain certain benefits ("Perks").

5.3 Missions available to you will be listed in the "My Missions" section of your user account. This section will list out the Missions already completed, provide details on the actions required for Missions you have not yet completed and set out how many Roses you can earn for completing each Mission. Roses will be awarded to your user account following completion of each Mission and the subsequent validation by a Community moderator. Collected Roses will be stored in your account indefinitely unless (a) you terminate your user account with us, or (b) we terminate your user account with us due to you breaching these Community Terms.

5.4 We may change, add or amend the Missions and/or how many Roses can be earned for any Mission not yet completed, at our sole discretion by amending the information in the "My Missions" section.

5.5 The table below sets out the Perks that you receive as a result of acquiring a certain number of Roses. We may update this table from time to time, including to introduce new Community levels for users who collect higher numbers of Roses.

We expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards as set out in the Community Guidelines, whether the service is moderated or not. (a) immediate, temporary or permanent withdrawal of your right to use our site;

(b) immediate, temporary or permanent removal of any contribution uploaded by you to our site;

(c) issue of a warning to you;

(d) legal proceedings against you for reimbursement of all costs, on a full compensation basis (including reasonable administrative and legal costs), resulting from the breach;

Draw Details

Prize Draw Date: 14 March 2024 

Notification of Winner(s):

  • The winner will be selected at random from the pool of entrants who (a) answered the question posed on the Sheerluxe website correctly; and (b) completed and submitted the online form with their personal details. The winner will be notified by the Co-Promoter via email,  using the email address submitted via the online entry form, on 14 March 2024
  • If the winner does not respond to the Co-Promotor within 3 weeks of being notified of their winning entry to provide their delivery address details for the Prize to be dispatched, the Co-Promotor reserves the right to withdraw their prize and offer it to an alternative entrant selected at random.

Delivery

Prize Delivery: Please allow up to 30 days from the date the winner supplies the requested details for delivery of the prize to the Co-Promoter.

Entry and eligibility

  1. Entries must be received between the Entry Open Date and the Entry Closing Date.
  2. The prize draw is free to enter and no purchase is necessary.
  3. Promoter’s or Co-Promoter's (or any of Promoters' or Co-Promoter's group companies') employees, their immediate family, those living in their same households (whether or not related) or any third party directly associated with the promotion are not eligible to enter.
  4. Incomplete, illegal, misdirected or late entries will not be valid.  Proof of complying with the How to Enter Requirements will not be accepted as proof of receipt or entry. Promoter or Co-Promoter is not responsible for entries lost, damaged or delayed due to technical or connectivity or other problems.
  5. Only one entry per person. Bulk entries from trade, consumer groups or third parties will not be valid. Multiple entries made by the same person from various email, social media or other accounts or from the same IP address will not be valid.
  6. Any entries which do not comply with the How to Enter Requirements or the Submission Requirements and Restrictions, or which contain any third party intellectual property without prior informed consent from the rights holder, or which violates or infringes another’s rights, including but not limited to privacy, publicity, or which contain any abusive, inappropriate, offensive or obscene language or imagery will be disqualified. Examples of language/images considered to be inappropriate, offensive or obscene, include (but are not limited to) any message/image which contains: (a) swearing; (b) comments or actions which appear to be discriminatory of any person, company or group of individuals, for example comments of a racist, sexist or homophobic nature; (c) comments or actions which promote bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age (d) sexual innuendo, sexual language or sexual acts, actions or gestures; (e) promoting any illegal unlawful activity such as drug use; (f) content which is tortious, defamatory, slanderous or libellous; (g) any message that appears to be an advertisement or solicitation to buy; and (h) any materials (whether written or visual) that directly or indirectly relate to Promoter’s competitor brands or that show any intention of promoting any brand other than Promoter brand.
  7. The Promoter and Co-Promoter reserves the right to require entrants to prove that they are eligible to enter the prize draw.  If a winner is found to be ineligible, the Promoter and Co-Promoter reserves the right to select, at random, an alternative winner from all other eligible entrants to receive their prize and to require the return of any prize already awarded.

Prize fulfilment and disqualification

  1. The prize is as stated, it is not transferable and there are no alternative prizes or cash substitutes. Promoter and Co-Promoter reserves the right to substitute a prize of equal or greater value in the event that the selected prize is unavailable for any reason whatsoever.
  2. A winner forfeits their prize and the Promoter and Co-Promoter reserves the right to select at random an alternative winner if:
  1. within 3 weeks of being notified by the Co-Promoter, a winner does not respond or does not provide their full name and relevant details (if applicable, details for the prize to be despatched to in the eligible country of residence); or
  2. if a prize is rejected or returned undeliverable; or
  3. if an entry is invalid or an entrant is disqualified or in breach of these Terms and Conditions.

Promotional Activity relating to the prize draw

In entering the prize draw, all entrants and winners agree to participate in any promotional activity relating to the prize draw, which may include entry content, voice, image and name for publicity purposes (in any media, print or online, including any websites, social media sites or third party retailer websites) and in advertising, marketing or promotional material (whether or not related to the prize draw) free of charge without additional compensation or prior notice. License to use your content: You grant to L’Oréal (U.K.) Limited and its affiliates and/or related entities, on behalf of the brand that contacted you about the use of your content via a private/direct message on a social media platform (collectively “Brand”), a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable right to use, store, reproduce and communicate your video, photo, post and/or other content posted to social channels, including but not limited to Instagram, Facebook, Twitter, TikTok, Snapchat, YouTube or Google+, which was specified in the Brand’s cover message to you, together with your social media handle, social media user name, profile picture, caption and location information you may have included in your content (“User Content”) that you have tagged with any hashtags/handles associated with the brand that contacted you about the use of your content (“Hashtag(s)”), in any format including but not limited to in: (i) any advertising, PR or marketing material (print, POS, media or online); (ii) educational material; (iii) brand internal material; (iv) on brand or third party websites (e.g. retailer websites) and (v) on brand or third party social channels (e.g. retailer social channels), including Facebook, Instagram, Twitter, YouTube, Snapchat, TikTok or similar.
